In residential construction, most projects will follow one of three compliance pathways.
Deemed-to-Satisfy.
Performance Solutions.
Report and Consent.
They are terms most practitioners are familiar with.
But in practice, the challenge is not understanding what they are.
It is understanding when they apply, and what they actually mean for the project.
At Deemed to Perform, this is one of the most common areas where uncertainty shows up. And in many cases, that uncertainty is what leads to RFIs, redesign and delays later in the permit process.
Because each pathway carries a different level of complexity, documentation and risk.
Getting that decision right early makes a significant difference.
DEEMED-TO-SATISFY: CLEAR IN PRINCIPLE, NOT ALWAYS IN PRACTICE
Deemed-to-Satisfy (DTS) is the most commonly used compliance pathway.
It involves aligning directly with the prescriptive provisions set out in the National Construction Code.
On the surface, it is straightforward. Follow the provisions, demonstrate compliance and proceed.
But in practice, it still relies on accurate interpretation.
We regularly see projects where the intent is to follow DTS, but the documentation does not fully align with the relevant clauses. This might be a missing detail, a difficult site arrangement or a misinterpretation of how a provision applies to a specific design.
Individually, these can seem minor.
But they tend to surface later as RFIs, revisions and avoidable delays.
At Deemed to Perform, this is often where early review adds the most value. Making sure the documentation clearly reflects the requirements before submission reduces uncertainty and supports a smoother approval process.
PERFORMANCE SOLUTIONS: FLEXIBILITY THAT REQUIRES CLARITY
Performance Solutions provide an alternative pathway where DTS provisions cannot be met.
Rather than following prescriptive rules, the design must demonstrate that it satisfies the Performance Requirements of the code.
This opens up greater flexibility in design.
But it also introduces a higher level of responsibility.
Performance Solutions typically involve technical analysis, supporting reports and coordination across multiple disciplines. Engineers, consultants and building surveyors all play a role in demonstrating that the proposed solution achieves the required outcome.
Where we see issues arise is not in the concept itself, but in the timing.
When a Performance Solution is identified early, it can be planned, documented and assessed with clarity.
When it is identified late, it often introduces additional complexity, rework and extended timeframes.
REPORT AND CONSENT: NOT A BARRIER, BUT A PROCESS
Report and Consent applies when a design varies from prescribed siting provisions under the Building Regulations.
This might include reduced setbacks, increased building height or variations to site coverage and overlooking provisions.
In these cases, approval is required from the relevant authority, typically council.
Report and Consent is often viewed as a problem.
In reality, it is a process.
The challenge is not the requirement itself, but when it is identified.
At Deemed to Perform, we regularly see projects where Report and Consent is only picked up after the design has progressed. By that point, the pathway becomes longer, and the ability to adjust the design becomes more limited.
Identifying these triggers early allows for better planning, consultation with neighbours where needed, clearer documentation and a more controlled approval process.

Across all three pathways, the pattern is consistent.
It is not the requirements themselves that cause issues.
It is the uncertainty around how they apply.
Each pathway introduces different expectations around documentation, assessment and approval timeframes.
When that pathway is clearly identified early, the rest of the process becomes more predictable.
When it is not, the project often slows down as those decisions are made later under pressure.
