When construction work is about to begin, most of the focus is on the new structure itself. But just as important is what happens to the neighbouring properties and how we document their condition before the first shovel hits the ground. This is where Dilapidation Reports and Protection Works come in. These tools are often underestimated, yet they are critical for protecting builders, owners, and neighbours throughout the construction process. 

What Are Dilapidation Reports?

A Dilapidation Report is a detailed record of the existing condition of neighbouring properties before construction begins. It documents any cracks, settlement, or structural wear and tear so that there is an agreed baseline. If a neighbour later claims that construction caused damage, the report provides evidence of what was already there before works commenced. 

For builders and owners, this documentation is invaluable. It reduces the risk of disputes, prevents false claims, and helps avoid costly litigation. For neighbours, it offers peace of mind that their property’s condition has been independently recorded and respected 

Importantly, a Dilapidation Report also forms part of the agreed survey required under the Protection Works process, as set out in Section 94 of the Building Act. This makes it a formal requirement in many cases, not just a precautionary step, and ensures that all parties have a legally recognised record before work proceeds. 

Why Protection Works Matter

Under Part 7 of the Building Act, Protection Works are required whenever building work poses a risk of significant damage to adjoining properties. This might include excavation, underpinning, or building close to shared boundaries. The Protection Works process involves notifying the adjoining owner, providing detailed information about the proposed works, and setting out the specific measures that will be taken to protect their property. The roles and obligations of the owner, the relevant building surveyor and the adjoining owner are set out in Sections 84 to 101 of the Building Act. The Relevant Building Surveyor (RBS) plays an important independent role here, ensuring that the protection works are adequate and that the adjoining owner has been correctly served with sufficient information to make an informed decision. This process not only safeguards neighbours but also ensures that builders and owners can move forward without unnecessary interruptions.
